These Terms of Service govern your use of hardrx.net and the HardRx telehealth service. By using this site you agree to them. If you do not agree, please stop using the site.

1. What this service is — and is not

Hard Health facilitates telehealth consultations between patients and independent licensed providers. Hard Health is not a medical provider and does not practice medicine. We do not make prescribing decisions. Independent licensed physicians review your information and decide whether treatment is appropriate; a licensed pharmacy dispenses any prescription issued.

No physician-patient relationship is created between you and Hard Health. Any such relationship is with the independent provider who reviews your case.

2. Eligibility

You must be at least 18 years old, located in a state where the service is available, and able to enter a binding contract. HardRx is intended for adult men. By using the service you confirm you meet these requirements.

3. Accurate information is your responsibility

You agree to provide truthful, accurate and complete information in your health questionnaire and to keep it current. Withholding or misrepresenting medical information — particularly current medications — can lead to serious harm and may result in refusal or termination of service. The reviewing physician relies entirely on what you disclose.

4. No guarantee of approval

Submitting a questionnaire does not entitle you to a prescription. A physician may decline if the treatment is not appropriate for you. If you are not approved, you are not charged.

5. Prescriptions and use

Any medication prescribed is for your personal use only. Do not share it. Take only your prescribed dose and never more than one dose in a 24-hour period. Follow the directions on your medication label and the guidance on our safety page.

6. Payment and subscriptions

Prices are shown at checkout in USD. Subscription plans renew automatically at the stated rate until cancelled. You may pause, adjust or cancel before your next shipment processes; once a shipment has been charged and processed it cannot be cancelled, although future refills can be stopped. You authorise us to charge your payment method for the plan you select, including recurring charges, until you cancel.

7. Acceptable use

You agree not to: use the service unlawfully; misrepresent your identity, age or health status; attempt to obtain medication for another person; interfere with the security or operation of the site; scrape or copy content without permission; or introduce malicious code.

8. Intellectual property

The text, design, layout and original graphics on this site are protected by copyright and remain the property of Hard Health or its licensors. Viagra® is a registered trademark of Pfizer Inc. and Cialis® is a registered trademark of Eli Lilly and Company; HardRx is not affiliated with, endorsed by or sponsored by either company, and references to those marks describe the active ingredients sildenafil and tadalafil only.

10. Disclaimer of warranties

This website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, Hard Health and its operators shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of this website or the service. Nothing in these terms limits liability that cannot lawfully be limited.

12. Indemnity

You agree to indemnify and hold harmless Hard Health and its operators from any claim arising out of your breach of these Terms, your misuse of the service, or information you provided that was inaccurate or incomplete.

13. Privacy

Your use of this service is also governed by our Privacy Policy, which forms part of these Terms.

14. Changes

We may revise these Terms at any time. The revised version will be posted here with an updated effective date, and continued use constitutes acceptance.

15. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
